We are pleased to share that our client’s composite device mark has been successfully accepted for registration following detailed legal arguments before the Trademark Registry.

The applied-for mark, rich in artistic design, stylization, and verbal elements, was initially objected to under Section 9(1)(b) of the Trade Marks Act, 1999. The objection claimed the mark was descriptive and lacked distinctiveness.

Our arguments emphasized:

  • The mark is a composite label with unique graphical and textual components and must be viewed as a whole.

  • Continuous use since November 5, 2024, has established acquired distinctiveness and secondary meaning in trade.

  • The label is not descriptive but serves as a badge of origin that clearly identifies our client’s goods.

We relied on key judgments from the Hon’ble Delhi High Court:

  • Abu Dhabi Global Market v. Registrar of Trademarks (MANU/DE/3347/2023)

  • Navaid Khan v. Registrar of Trademarks (MANU/DE/3717/2023)

  • Muneer Ahmad v. Registrar of Trade Marks (MANU/DE/7817/2023)

Each of these decisions reiterates that device marks must be evaluated in their entirety, and composite marks are not to be dissected for descriptiveness.

With this acceptance, the Registry has rightly recognized the mark’s inherent and acquired distinctiveness, upholding the integrity of composite trademarks under Indian law.

FIR Registered | FMCG Copyright Infringement Action Executed | FMCG Sector 

We recently assisted our client, a leading player in the FMCG sector, in successfully executing a copyright enforcement action in Champaran, Bihar, targeting unauthorized replication of protected packaging.
An FIR was duly registered, and a search and seizure operation was carried out with the active cooperation of the Superintendent of Police, Deputy Superintendent of Police, and the team at Shikarpur Police Station. Their swift support was crucial and commendable, ensuring effective on-ground action and deterrence against the infringer.
This action reinforces the critical role of enforcement mechanisms and police collaboration in safeguarding intellectual property — especially in industries like FMCG, where brand identity and packaging are key market differentiators.
